REAL ESTATE AUCTION TERMS & CONDITIONS:

1. REAL ESTATE WILL BE OFFERED TO PROSPECTIVE BUYERS AT 6:00 P.M. Bidding will be via ZOOM app (video conference); or phone bid; or on-site with proper social distancing.

2. Buyer(s) and Buyer’s Agent(s) must have made all inspections prior to auction time. The Property sells “AS IS” with no guarantees. Buyer will be operating on his/her own judgment. The Property will be sold “AS IS” with no contingencies (such as inspections or financing approval). There will be NO improvements made to the property and no “Final Inspection” and no “Final Walk-Through” because this property is selling “AS IS” at this auction. Possession given 6/21/20. If the Buyer is represented by another brokerage, they must be registered prior to auction day and sign a Broker Cooperation Agreement with James L. Johnston.

3. The home will be sold subject to Seller’s confirmation.

4. BUYER(S) WILL PAY $5,000 DOWN IN ESCROW DAY OF AUCTION & REMAINDER DUE AT CLOSING WITHIN 30 DAYS. Escrow and closing at Boyd & Boyd Abstract, Fulton, MO

5. Buyer(s) and Sellers will sign a standard MAREP contract day of auction. Seller will furnish a Warranty Deed. Title insurance and closing costs will be divided equally between Buyer and Seller. Buyer will be responsible for Lenders Policy and all expenses pertaining to any loan.

6. Real estate taxes for 2019 were $1,127.76. Taxes will be prorated at date of the closing. Total utilities average for the past year were $241.69 (electric, gas, water, sewer, garbage)

7. Seller has no knowledge of lead-based paint in the housing, but the home was built before 1978. The Seller has no reports or records pertaining to lead-based paint and/or lead-based paint hazards in the housing. Please refer to the “Protect Your Family from Lead in Your Home” pamphlet. The Seller also has no inspections for Radon Gas or Methamphetamines/ Controlled Substances on this property but they do not think any exists.

8. The Seller and Auction Company are not responsible for any accidents, errors or omissions, lost or stolen items.
